The first question of Fatwa No. ( 4273 )
Q1: My father passed away, leaving behind money and real estate. I have brothers and sisters, and the eldest brother is the one who oversees the properties and the two factories they own. He deals with interest-based banks through riba (usury or interest), and I am not pleased with this. I have tried many times up to now to separate my rights from my siblings, but I have not been able to do so yet. He is a partner with my mother and my siblings in eating and drinking from the funds that are mixed with riba. What is the ruling on mixing with my siblings in food and drink? Some of his acquaintances also deal with interest-based banks. What is the ruling on mixing with them, eating with them, and accepting their gifts?
A1: You should advise them and make it clear to them that dealing in riba (usury or interest) is forbidden by the Qur'an, the Sunnah, and scholarly consensus. As for eating with them, the ruling depends on the details: if it becomes clear to you that something is from forbidden earnings, it is not permissible for you to eat it; otherwise, it is permissible for you to eat from it. The same ruling applies to eating from the food of your relatives and acquaintances. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
