Q: I submit this question to your eminence: I have four sons and three daughters. One of the daughters is married, and two are young and employed. Of the sons, two are employed and two are studying. The employed ones have no money to their name other than the value of their cars and their rent. One of them wishes to marry, and his wife is from my side, though he has provided only a little assistance. Soon, if Allah wills, I will marry his brother, and I will record in my halal property for those
who are studying, in exchange for what I spend on the marriage of their two brothers. I have bought four residential land plots for the sons, one plot for each of them to live in. As for the employed ones, they have applied to the bank; if Allah wills, their names will appear on the bank’s records and they will build and reside there. Their two brothers, if Allah wills, will follow suit in applying, building, and residing. Therefore, I ask for clarification: Should I buy land for the daughters in exchange for what I bought for the sons, or should I record money for them in my halal property? Do they have a claim on what I spend on the marriage of the sons, or not? Is there zakah on the land plots bought for the sons before their names appear on the bank’s records and they build, or not? Please issue a ruling, may Allah reward you with good.
A: First: It is obligatory for you to be just among your children, so you should buy for the daughter half of what you bought for the son, or give her money equivalent to that. Second: You do not owe zakah on the aforementioned land plots, because they are not intended for trade. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
