The fourth question of Fatwa No. ( 9271 )
Q4: My father has a piece of agricultural land, and he gave my brother a portion of it in exchange for reviving this land. Is this permissible even if the heirs do not agree to it?
A4: If your father owns the aforementioned land with full ownership, and he gave your brother a portion of it to develop the whole of it, and the agreement between them was free from favoritism, then that is permissible. If a dispute arises in this matter, the reference is to the court. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
