Building on Shared Inherited Land

The second question of Fatwa No. ( 11933 )
Q2: It happened that I built a reinforced concrete house with my earnings and salaries on a piece of agricultural land. This piece of land is from my father’s estate and is my share from the division. I have a married sister with me, but she is in our father’s inheritance. During the division, it became with me, meaning: her inheritance became included with my inheritance equally. So I am inquiring about this house that I built with my salaries and job on
this piece of land where my sister is a partner with one-third share. How should I deal with my sister? Do I buy the third of the land from her, or do I ask for it from her? And if she permits it, is it permissible? Because I want to avoid doubtful matters.
A2: If the mentioned piece of land is your share and your sister’s share from your father’s estate, then your sister has one-third of the piece or one-third of its current value, unless she waives her share and she is of sound mind, in which case there is no harm. And if a dispute arises between you regarding any of what was mentioned, the reference is the court. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
