Q: We ask you, may Allah reward you, to issue a ruling on the case of a man who has several sons, some from his wife and some from his concubines, and he wants to allocate two-thirds of his land and real estate to the concubines and their sons, making it an endowment for them to the exclusion of his other sons. Is this valid?
A: It is not permissible for him to endow property for some of his children to the exclusion of others, because this is a biased endowment, and it is forbidden. This is based on the saying of the Prophet (peace and blessings be upon him):Sahih al-Bukhari 2587 Agreed upon by al-Bukhari and Muslim. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
