Ruling on endowing for sons to the exclusion of daughters
Machine translationRead the Arabic original
Question: His Eminence the Shaykh / Abdul Aziz ibn Abdullah ibn Baz, the Grand Mufti of the Kingdom of Saudi Arabia (may Allah preserve him).
Peace be upon you, and Allah’s mercy and blessings, and after that:
I have read your response to my previous submission regarding the endowment building in Ta'if, and we will act according to your opinion, if Allah wills, and may Allah reward you with good. On this occasion, I would like to consult your Eminence on a similar matter. By the grace of Allah, I own a building in Makkah al-Mukarramah, and I wish to endow it first for residence and utilization, then for my children, then for my grandchildren, forever, as long as they have descendants, specifically the descendants of the males to the exclusion of the descendants of the females; the upper generation excludes the lower generation. If they become extinct, may Allah keep us safe, it will become an endowment for the poor and the needy. Is there any religious prohibition in endowing for the descendants of the males to the exclusion of the descendants of the females? This is what I wished to consult you about. May Allah preserve you and protect you, benefit us with your knowledge, and grant you health and success.
And peace be upon you and the mercy of Allah and His blessings.
With your Eminence's knowledge that I adhere to the school of jurisprudence of Imam Abu Hanifah al-Nu'man (may Allah have mercy on him).
Answer: And upon you be peace, and Allah’s mercy and blessings, and after that:
We see that the endowment should be for the needy among the descendants, whether they are from the descendants of the males or the females, generation after generation, and whoever Allah has made wealthy does not share with the poor. If they become extinct, the income is to be spent in the causes of good; such as charity for the poor, the maintenance of mosques, and the like of causes of good. We ask Allah for success for us and for you in all good; He is the All-Hearing, the Near. And may peace and the mercy of Allah and His blessings be upon you.
