Q: I have a farm, and I have given it to a farmer on a fifty-fifty basis; he gets half the produce and I get half. I bear all the expenses, such as the vehicle, plowing, fertilizer, the machine, fuel, and seeds. Praise be to Allah, we receive good from Allah. I record what comes to me from my account from the beginning of the year, 1/1/1403 AH, to 30/12/1403 AH. Then I total my personal income and pay 2.5% as zakah, which I give to the eligible recipients. However, I do not deduct from the total what I lose in purchases, nor do I consider whether the nisab (minimum threshold) is met or not; because, praise be to Allah, I have another income from my job and my situation is comfortable, praise be to Allah. Likewise, I do not add the farmer’s share of the other half to the zakah calculation; rather, it is only my share. What is your opinion on this? May Allah reward you. Since the farm was not for trade, but is a farm from my father’s estate, it is small and irrigated by machine, and the zakah is on the grains and fruits, just as zakah is paid on the legumes, vegetables, and the like that result from it, as zakah on the produce of money. I ask for your guidance.
A: You must pay zakah on the grains and fruits, namely dates and grapes, if they reach the nisab. The nisab is five wasq, which is three hundred sa’ (a dry measure of about 3 kg) by the sa’ of the Prophet (peace and blessings be upon him). The sa’ is four full handfuls with two moderate hands.
The obligatory amount is half of one-tenth, which is fifty kilograms from every one thousand kilograms, for example. As for money, its zakah is, as you mentioned, two and a half percent. As for the partner’s share, its zakah is his responsibility if it reaches the nisab. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
