Fatwa number ( 3646 )
Q: A personwas required to pay three one-year-old she-camels as zakah on his camels, but he did not give them; instead, he gave one two-year-old she-camel and one one-year-old she-camel in their place. Does this suffice?even though he has many one-year-old she-camels among his camels? And a person was required to pay two two-year-old she-camels as zakah on his camels, but he gave two one-year-old she-camels and one two-year-old she-camel in their place. Does this suffice, even though he has many two-year-old she-camels among his camels?
A: It is obligatory for the one paying zakah to pay the specific items specified for the zakah of grazing livestock, and he should not deviate from them except when they are unavailable; due to the hadith of Anas (may Allah be pleased with him) recorded in the Sahih of al-Bukhari . If the situation is as described, then the one who paid a haqah and a bint labun in place of the three bint labun he was obligated to pay must pay another bint labun, and the haqah suffices for the second bint labun because it is of higher value. And the one who paid two bint labun and a haqah in place of the two haqah must pay the difference in value between the haqah and the two bint labun in cash, if their value is less than the value of the middle haqah.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and companions.
