Praise be to Allah alone, and peace and blessings be upon His Messenger Muhammad, his family, and his Companions. And after that: The Permanent Committee for Scholarly Research and Ifta has reviewed the letter sent to His Eminence the President General from the Prime Minister, No. 2620/8, dated 22/12/1404 AH, which reads: We are sending you a copy of the letter from His Excellency the Minister of Municipal and Rural Affairs, No. 235/S, dated 11/8/1404 AH, and its attachments. Regarding the problem faced by the Municipality of Riyadh concerning the burial of non-Muslims, who belong to various nationalities, and the necessity of burying them or some of their members, which are amputated from them due to surgical operations. And what His Excellency clarified is that the Municipality, in one case, buried a body outside the city at a distant location, and that the Municipality requests the issuance of a religious ruling regarding designating a cemetery for non-Muslims. We inform you that we see that this matter requires detail, as burying the members is a simple issue, where they can be buried in any place, whereas for the bodies, it is possible to send them to their countries and the problem will be resolved,
and perhaps that will be a solution to the matter, and we request you to study this topic and inform us of your views regarding it. End of quote.

After the Committee studied what His Majesty mentioned, it issued the following ruling: It is not permissible to bury disbelievers, whatever their religions may be, in the cemeteries of Muslims, nor is it permissible to bury their amputated members in them. It is also not permissible to designate a special cemetery for them in the land of the Arabian Peninsula to bury their dead or their amputated members; due to the religious and worldly harms that result from this. However, the body is handed over to its guardian, and the amputated member is handed over to its owner or his guardian, to be transported to wherever he wishes outside the land of the Peninsula. If the guardian of the body refuses to accept it, or the owner of the amputated member or his guardian refuses to accept it, and it is not possible to take it out to be buried outside the Peninsula, it is buried in an unknown piece of land that is not owned by anyone; to fulfill the obligation of covering it, and to strive for safety from its harm. It is not permissible to obligate the treasury of the Muslims to transport it outside the Peninsula; because there is no evidence for that. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
