Q: A group of Muslims in the city of Brussels in Belgium are honored to request a fatwa from your eminence regarding the burial of Muslims in a Christian cemetery or elsewhere. We have decided to establish an Islamic cemetery in this country, as the Belgian government has requested a fatwa from you, given that you are making every effort to spread this religion. Awaiting your response, please accept from us, my esteemed Mufti, our highest respect.
A: It is obligatory to bury Muslim deceased in a separate cemetery exclusively for them, and it is not permissible to bury them in the graveyards of non-Muslims. The Imam al-Shirazi said in al-Muhadhdhab: “A disbeliever is not to be buried in the Muslims’ cemetery, nor a Muslim in the disbelievers’ cemetery.” And the Imam al-Nawawi said in al-Majmu’: “Our scholars (may Allah have mercy on them) agreed that a Muslim is not to be buried in the cemetery of disbelievers, nor a disbeliever in the cemetery of Muslims.” From this, it is evident that it is obligatory to designate a place for the burial of Muslim deceased in a cemetery specifically for them.
