Q1: While we were performing the 'Asr prayer in congregation, in the second rak'ah, the imam stood up after prostration without sitting for the first tashahhud (forgetfully) and began the third rak'ah. Some of the worshippers behind him reminded him (saying "Subhan Allah"), but the imam continued his prayer. Before the taslim, in the final tashahhud, he performed the two prostrations of forgetfulness. After finishing the prayer, he said: "The first tashahhud is a sunnah and not a pillar, and it is not befitting to sit for it in a state of forgetfulness." What is the ruling on this?
A1: The first tashahhud in prayer is obligatory among its obligations according to the most correct of the scholars' opinions; because the Prophet (peace and blessings be upon him) used to do it and said:
offer your prayers in the way you saw me offering my prayersصلوا كما رأيتموني أصلي

And when he left it due to forgetfulness, he prostrated for forgetfulness. Whoever leaves it intentionally, his prayer is invalid. Whoever leaves it due to forgetfulness, he makes it up with the prostration of forgetfulness before the taslim of the prayer, whether he is an imam or praying alone. And what the imam did is valid; because when the Prophet (peace and blessings be upon him) left the first tashahhud forgetfully, he prostrated for forgetfulness. Its authenticity is agreed upon from the hadith of 'Abdullah ibn Buhaynah (may Allah be pleased with him).
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
