Question:
If a person prays a prayer, let us suppose, for example, that he prayed the Maghrib prayer, and he completed the first two rak'ahs, but he did not sit for the first tashahhud because of forgetfulness, what is required of him in this case?

Answer:
If he did not sit for the first tashahhud, he must perform the prostration for forgetfulness, whether in Maghrib, or Zuhr, or 'Asr, or 'Isha'. The point is: if he leaves out the first tashahhud out of forgetfulness, it is obligatory for him to perform the prostration for forgetfulness in Zuhr, 'Asr, Maghrib, and 'Isha all alike. However, if he is reminded or he remembers before he has fully stood up, he should go back and sit, and recite the tahiyyat. If he has fully stood up, and did not notice, and was not reminded, he should complete his prayer, and praise be to Allah.
This happened to the Prophet (peace and blessings be upon him), for he (peace and blessings be upon him) stood up from the first tashahhud out of forgetfulness. When he finished his prayer and completed it, he prostrated two prostrations before he said the taslim, before he said the taslim (peace and blessings be upon him). So the Ummah is likewise, as Allah the Exalted said:
There has certainly been for you in the Messenger of Allah an excellent patternلَقَدْ كَانَ لَكُمْ فِي رَسُولِ اللَّهِ أُسْوَةٌ حَسَنَةٌ
[Al-Ahzab: 21]. So if the imam or the one praying alone leaves out the first tashahhud, and does not notice, and is not reminded until he has fully stood up, he should complete his prayer and prostrate for forgetfulness before he says the taslim. If he is reminded and goes back before he begins the recitation, there is no harm; that is sufficient, and he must perform the prostration for forgetfulness. However, not going back is better if he has fully stood up; he should continue and complete his prayer.
As for if he has begun the recitation, it is forbidden for him to go back. He should not go back; he should continue until he completes it, then prostrate for forgetfulness.
As for the ma'mum, nothing is required of him. If the ma'mum stood up in a state of distraction and then sat down following his imam, nothing is required of him. The ma'mum follows his imam, provided he is not masbuq, but rather entered with him from the beginning of the prayer. However, if he became distracted and stood up while his imam was sitting for the first tashahhud, and he stood up, he should return and sit with his imam, and nothing is required of him; he does not have to perform the prostration for forgetfulness.
Likewise, if he adds a prostration out of forgetfulness, or a bowing out of forgetfulness, his prayer is not invalidated. He follows his imam, and he does not have to perform the prostration for forgetfulness, because he follows his imam. Likewise, if he forgets "Subhan Rabbi al-A'la" in the prostration, or "Subhan Rabbi al-Azim" in the bowing, and he is a ma'mum, he does not have to perform the prostration for forgetfulness.
