Q: We inform you that our father (may Allah have mercy on him) passed away three years ago. We have settled all the amounts he owed, and only the mortgage bank remains. One of his sons undertook to pay all the remaining installments when they come due, and he is now ready to pay the future installments. The request is: 1 - Does our father's estate remain liable for the mortgage bank debt, given that we are now paying each installment on time, or are we required to pay the entire mortgage bank amount? 2 - We have a farm belonging to our father that yields an annual return exceeding the value of the annual installment. If we sell the farm or part of it, we will pay off the entire amount owed to the mortgage bank.
A: You are not required to accelerate the repayment, and there is no harm in deferring it until its due date. This will not harm your father, if Allah wills, because Muslims are bound by their conditions.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
