Question: My father had a debt with the mortgage bank, and he passed away (may Allah have mercy on him). Do we have to pay the full amount, or according to the installments approved by the bank, such that his liability is thereby discharged?

Answer: It is not obligatory to expedite its settlement if the heirs or others commit to paying it at its due times, in a manner that poses no risk to the creditor; because the deferral is among the rights of the deceased, which his heirs inherit, and there is no harm to the deceased in that, if Allah wills; because a deferred debt is not obligatory to settle except at its due time, and the heirs take the place of the deceased if they commit to this, or if others commit to it in a manner that poses no risk to the creditor, as mentioned above.
