Question:
The first message in this episode is one that reached the program from Dammam. The sender is one of the sisters from there, and she says: The sender is Umm Ahmad al-Hafi. Umm Ahmad has four questions for Shaykh Abdul Aziz.
In her first question, she asks: Is a loan from the Real Estate Bank or the Agricultural Bank considered a debt on a person if he borrows it and dies before paying it off? And what is obligatory for the heirs regarding this? Because in reality, they want the deceased to be at ease. If they cannot pay the bank quickly, what is the ruling?
Answer:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send blessings and peace upon the Messenger of Allah, and upon his family and his Companions, and upon those who follow his guidance.
After that: The loan from the Real Estate Bank, and from other banks such as the Agricultural Bank, is like any other debt. It must be paid at its due time, whether the person is alive or dead. If a person dies and he has a debt to the bank, it is obligatory that it be paid from the estate at its due times if the heirs undertake to do so. If they do not undertake to do so, it must be paid immediately from the estate, so that the deceased is relieved of the burden of the debt. It was reported in a hadith from him (peace and blessings be upon him) that he said:Jami` at-Tirmidhi 1078Hasan (Darussalam).
But if the debt is deferred and the heirs—or some of them—undertake that it will be paid at its due time, then it is deferred, and it does not harm the deceased, because it is deferred. If no one undertakes to pay it at its due time, it is obligatory that it be paid from the estate, so that the deceased is safe from the burden of that. Yes.
The presenter: May Allah reward you with good, Shaykh Abdul Aziz. If these loans are in the form of installments, what is your guidance?
The Shaykh: As mentioned before, each installment at its due time.
The presenter: Each installment at its due time.
The Shaykh: It is paid at its due time, unless there is no one among the heirs who undertakes to do so; in that case, the entire amount is paid from the same estate. Yes, like a due debt.
The presenter: Exactly like a due debt. May Allah reward you with good.
