All praise is due to Allah, and may blessings and peace be upon His Messenger, his family, and his Companions. After that: The Permanent Committee for Scholarly Research and Ifta has reviewed the inquiry submitted by the Association of Sharia and Islamic Studies at the University of Kuwait to His Eminence the Grand President, and referred to the Committee under number 269 on 8/2/1404 AH. The text of the inquiry is as follows: Given what the male and female students of the University of Kuwait are suffering from regarding the issue of the mixing of the two sexes in the same classroom, and by mixing I mean: the man and woman mixing with each other, including women who are clothed yet naked, and those who wear the hijab. Some have issued a ruling permitting mixed education, citing as evidence the mixing of men and women during the tawaf in Hajj and 'Umrah. It is known that zina has spread among the students who are not committed to Islam in the name of personal freedom, and their mixed trips have increased, in which only the male student and the female student are alone.
The university has become a display of the latest contemporary fashions, makeup, and hairstyles, with a large number of unmarried men and women. Therefore, we appeal to you to issue a ruling on our questions, clarify the truth from falsehood for us, and guide us to the right path. I hope you will be detailed in your answer, as it will be printed and distributed to the university students. The questions are: 1. Clarify the prohibition of mixed education with evidence, and respond to those who claim permissibility by citing tawaf. 2. On whom does the sin of our mixing in the university fall? Knowing that we always disapprove of it, and if we left the university, the corrupters would run rampant in it. 3. Does the attempt to reduce buildings, costs, teachers, and laboratories in the university permit mixing in order to save on the university's equipment and teachers?

And it answered as follows: First: The mixing of men and women in education is haram and a great evil; because of the fitnah, the spread of corruption, and the violation of sanctities contained in it. And what has occurred due to this mixing in the way of evil and moral corruption is among the strongest evidence for its prohibition. As for analogizing this to the tawaf around the Sacred House, it is an analogy with a difference, for the women used to perform tawaf in the time of the Prophet (peace and blessings be upon him) behind the men,
veiled, not mingling with them or mixing with them. Likewise was their state with the men in the Eid prayer ground, for they used to go out veiled and sit behind the men in the prayer ground. And when the Prophet (peace and blessings be upon him) delivered the Eid sermon to the men, he would turn to the women, remind them, and admonish them, so there was no mixing between men and women. Likewise is the case with their attendance at prayers in the mosques; they used to go out wrapped in their cloaks and pray behind the men, their rows not mingling with the rows of the men. We ask Allah to guide the officials in Islamic governments to eliminate mixing in education and to rectify their conditions, for He is the All-Hearing, the Responsive. Second: The responsibility falls upon the rulers and scholars in terms of guidance and implementation, and upon the specific guardian of the woman as well, each according to his capacity; based on what is established from the saying of the Prophet (peace and blessings be upon him):
You are all shepherds, and you are all responsible for your flock. The Imam is a shepherd and responsible for his flock, and the man is a shepherd in his household and responsible for his flock, and the woman is a shepherdess in her husband's house and responsible for her flock.كلكم راع وكلكم مسئول عن رعيته، فالإمام راع ومسئول عن رعيته، والرجل راع في أهله ومسئول عن رعيته، والمرأة راعية في بيت زوجها ومسئولة عن رعيتها
Sahih Ibn Hibban 23:13
... The hadith was narrated by al-Bukhari and Muslim . Third: The intention to save on expenses, equipment, and teachers does not permit mixing, for education is obligatory within the limits of ability, and coordination in it may eliminate many problems, and the woman's veiling in the Shari'ah dress eliminates many fitnahs. And whoever seeks good and follows the Shari'ah, Allah will make his path easy,
and guide him to the straight path. And Allah the Exalted said:
And whoever fears Allah - He will make for him a way out (3) And will provide for him from where he does not expect. And whoever relies upon Allah - then He is sufficient for himوَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مَخْرَجًا (2) وَيَرْزُقْهُ مِنْ حَيْثُ لاَ يَحْتَسِبُ وَمَنْ يَتَوَكَّلْ عَلَى اللَّهِ فَهُوَ حَسْبُهُ
[At-Talaq 65:2-3]
until He said:
And whoever fears Allah - He will make for him of his matter ease.وَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مِنْ أَمْرِهِ يُسْرًا
[At-Talaq 65:4]
And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his Companions.
