Praise be to Allah alone, and peace and blessings be upon His Messenger Muhammad, his family, and his Companions... And after: The Permanent Committee for Scholarly Research and Ifta has reviewed the inquiry submitted to His Eminence the General President by the Director General of Administrative Affairs at the Ministry of Commerce, referred by His Eminence with number 1939 on 29/4/1400 AH,
and its text is: I wish to inform your Excellency that this Ministry has, a few months ago, completed the construction of a mosque within the Ministry building in Riyadh , namely the Ministry of Commerce, to enable employees to perform their prayers there. This mosque is located on the first floor of the Ministry building, and directly beneath it are employee offices and a restroom (bathroom) under the rear part of the mosque. Some employees of the Ministry have stated that prayer is not permissible in the part of the mosque located above the roof of the restroom, citing a legal text that means prayer is not permissible on the floor of a bathroom, and that some hold that this ruling extends to the roof of the bathroom as it is considered part of its structure. Given the importance of this matter, we have decided to seek your Excellency's opinion on it... while informing you that the distance between the floor of the bathroom and its ceiling is three meters, and the thickness of the reinforced concrete slab forming the ceiling is 15 cm, followed by a tile of 10 cm thickness, and that the floor of the mosque is entirely covered with a thick carpet... I ask you to inform us of the legal ruling on this.
And it responded as follows: If the situation is as described, it is permissible to pray on the roof of the aforementioned restroom, and there is no harm, if Allah wills, nor is there any dislike in it; because the roof does not follow the original ruling in such a case, and this is the correct opinion among the
scholars on this issue, as explicitly stated by Abu Muhammad Ibn Qudamah al-Maqdisi (may Allah have mercy on him) in his book (Al-Mughni). And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
