The second question of Fatwa number ( 5566 )
Q 2: I took the book (Al-Mughni) by Ibn Qudamah, and I was astonished by the disagreement I saw in it regarding a matter of no importance. The Messenger of Allah (peace and blessings be upon him) warned us to avoid this by saying:Jami` at-Tirmidhi 2679Sahih (Darussalam) . It is true that the Messenger (peace and blessings be upon him) said: "The disagreement of my Ummah is a mercy," but it is not the kind of disagreement we see in our era in the books of jurisprudence.
A 2: Praise be to Allah alone, and blessings and peace be upon His Messenger, his family, and his Companions.. And after: What you mentioned in your question regarding the occurrence of disagreement in jurisprudential matters is not strange, for it is among the Sunnah of Allah with people that He made them differ in their understanding and intellects, in their access to the textual evidence, and in their grasp of the secrets of the universe and the laws Allah has deposited in it. So it is no wonder that they differ in matters of sacred and cosmic sciences, whether rational or textual. Indeed, that is the requirement of wisdom and the difference in creation and endowments. So you should not find it objectionable
that, but what is objectionable is for a person to speak out of ignorance, or following desire, or out of partisanship for the opinion of one whose school he follows. As for the one who looks at the cosmic and textual evidences with fairness in his independent legal reasoning, seeking the truth, he is praiseworthy, whether he is correct or incorrect. If he is correct, he has two rewards: one for his independent legal reasoning and one for hitting the truth. If he is incorrect, he is excused, and he has one reward for his independent legal reasoning; as indicated by the Sunnah of the Messenger of Allah (peace and blessings be upon him). And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his Companions.
