Q 2: Whatmakes the prohibition sometimes for dislike, and the command for recommendationin many rulings? Since the texts, as I think, came with the impermissibility of building, sitting, writing, and having intercourse on the grave, and leaning against it, whereasAhmadsays that it is disliked in (Zad al-Mustaqni') in the chapter: (The Funeral), and likewise the command for menstruating women and those in seclusion to go out to the two festivals, where the commentator of (Umdat al-Ahkam) considers it recommended for women
A 2: Praise be to Allah alone, and blessings and peace be upon His Messenger, his family, and his Companions... And to proceed: It may be due to the difference in the circumstances that accompany the command or the prohibition. If the command and the prohibition are free from circumstances, the default is: to take the command as obligatory, and to take the prohibition as forbidden. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his Companions.
