The Ruling on Prohibition in Islamic Legal Judgments

Machine translationRead the Arabic original
Question:
We return to the message from our brother Mahmoud Ahmad al-Dawsa from Iraq, Baghdad, al-Zafaraniyyah. Our brother sent many questions to this program, and we have already presented a large portion of them. Here, we are also presenting some of them in this episode. He asks and says: It is mentioned in some hadiths that the Messenger of Allah (peace and blessings be upon him) prohibited such and such actions. Is the prohibition a prohibition (tahrim), or does the prohibition mean dislike (karahah)?

Answer:
This is the original principle. The original principle is that prohibition is for prohibition (tahrim). The Prophet (peace and blessings be upon him) said in the authentic hadith:
Avoid that which I forbid you to do and do that which I command you to do to the best of your capacityما نهيتكم عنه فاجتنبوه وما أمرتكم به فائتوا منه ما استطعتم
Sahih Muslim 1337b
Thus he (peace and blessings be upon him) said:
Indeed, those who came before you were destroyed by their many questions and their disagreement with their prophets. So what I have prohibited from you, avoid it, and what I have commanded you, do as much of it as you are able.فإنما هلك من كان قبلكم بكثرة مسائلهم واختلافهم على أنبيائهم، فما نهيتكم عنه فاجتنبوه وما أمرتكم به فائتوا منه ما استطعتم
.
So the original principle regarding prohibition is that it is for prohibition (tahrim); this is the original principle. It is not shifted from prohibition (tahrim) to dislike (karahah) except by evidence indicating that. If he prohibited something and then did it, that indicates that it is a prohibition of dislike (karahah). Just as he prohibited drinking while standing, and then he drank while standing on some occasions, that indicates that it is not for prohibition (tahrim), and that it is permissible to drink while sitting or standing. However, if he drinks while sitting, it is better and more excellent. Just as he commanded standing for the funeral prayer, saying:
Whenever you see a funeral procession, you should stand up.إذا رأيتم الجنازة فقوموا
Sahih al-Bukhari 1311
, and then he sat on some occasions, that indicates that the command is not for obligation in this case.
So the rule is that whenever he prohibited something and then did it, that indicates that the prohibition is not for prohibition (tahrim), but for dislike (karahah) and that leaving it is preferable. And if he commanded something and then left it, that indicates that it is not for obligation. Otherwise, the rule is that commands are for obligation and prohibitions are for prohibition (tahrim). This is the rule. Yes.

The presenter: May Allah reward you with good.
