Fatwa No. ( 6833 ):


Q: What do the skilled, complete scholars say about a man who contradicts the definitive texts of the Noble Qur'an and the mass-transmitted Sunnah, and says in response to one who advises and admonishes him: "There is no harm in what I do, and I have done nothing wrong"? And when he wants to judge, he judges by falsehood and contrary to the Qur'an and Hadith. This judge does not pray or fast except rarely. He shows loyalty to disbelievers, open sinners, and one with corrupt beliefs, and he makes lawful what Allah has forbidden; such as making vows to other than Allah, drinking intoxicants, consuming usury or interest, bribery, and defective and invalid sales. He mocks the people of religion who are scholars, workers, and advisors, and says: "They are mad." And with this, he seeks authority by gathering the hearts of people to himself
by destroying the luxurious wealth in his hands. People lean toward him for the sake of their gain from acquitting the criminal, imprisoning their opponent, and torturing one who has no sin. After his victory, he intercedes with the people of the judiciary with a bad intercession so that the judge will acquit the oppressor and torture the oppressed. He scatters his wealth in defective ways, like flowing water in rivers. People come to him to congratulate him, singing and beating the drum, whether he is of bad belief or not. Is loyalty to such a man permissible in the pure Shari'ah, or is it forbidden? Is such a man a Muslim, or has he exited from Islam? Clarify, and you will be rewarded. May Allah reward you with the best reward in the abode of eternity. I have sought your fatwa for dissemination in all of Pakistan, so what is required from your eminence is speed. May Allah reward you.

A: If the reality is as mentioned, then one with this description is a disbeliever with a disbelief that takes him out of the religion of Islam. It is not permissible to show loyalty to him. Rather, it is obligatory for one who is qualified for advising and guiding to advise him and guide him to the truth and establish the proof against him. If he persists in his misguidance, it is obligatory for the one in authority over the Muslims to punish him with what the Shari'ah requires. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
