The first question of Fatwa No. ( 4461 ):
Q1: Some scholars have said: The polytheists of this Ummah are in the same position as the People of the Book regarding the permissibility of their slaughtered animals and their women; because the book of the Jews is
the Torah and their prophet is Musa (peace be upon him), even if they were liars, and likewise the Christians whose book is the Gospel and whose prophet is Isa, even if they were liars; because all of these claimed that and then abandoned their religion, and likewise the polytheists of this Ummah claim that their book is the Qur'an and their prophet is Muhammad (peace and blessings be upon him), and therefore it is permissible to marry their women and their slaughtered animals are permissible, just like those of the People of the Book .

A: One who believed in Muhammad (peace and blessings be upon him) and then associated others with Allah by prostrating to other than Allah, or making vows, or slaughtering for other than Allah, is not like the People of the Book , but rather he is an apostate who is given three days to repent after the truth is explained to him with its evidence and he is guided to it. If he repents, well and good; otherwise, he is killed. His wealth goes to the Bayt al-Mal of the Muslims; his Muslim relatives do not inherit from him, his slaughtered animals are not permissible, and he is not married to a Muslim woman. Rather, his marriage contract with any Muslim women he was with is annulled. This is unlike the disbelievers who are the People of the Book , for they are allowed to keep their marriages, inheritance exists between them, their slaughtered animals are permissible, and they are invited to Islam. If they repent and embrace Islam, praise be to Allah; otherwise, the jizyah is taken from them, and they are not killed for their disbelief. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
