The fourth question of Fatwa No. ( 4259 ):
Q4: Is it permissible to build mosques on the graves of the righteous friends of Allah, and is it permissible to pray in these mosques when there are other mosques in the same town that are free of graves?

And it is not permissible to pray in these mosques; because the Prophet (peace and blessings be upon him) said:Sahih Muslim 529 It is agreed upon as authentic, and because he (peace and blessings be upon him) said: Sahih Muslim 532 , which was narrated by Muslim in his Sahih, and Muslim also narrated from Jabir ibn 'Abd Allah from the Prophet (peace and blessings be upon him) Sahih Muslim 970a . And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
