Fatwa No. ( 9524 ):
Q: If I am a government employee, the government system does not permit me to open a commercial shop in my name. If I open this shop in the name of another person who is not an employee, and I manage this shop under a legal agency that authorizes me to buy and sell and do everything the name-holder does, and I bear its profit and loss, is this permissible?
A: If the situation is as you described, it is not permissible for you to do so; because of the lying, deception, and fraud involved against the one in authority, in order to contravene what he has established to protect the management of government work, which was entrusted to you as a service to the nation, with regard for the public interest, and to prevent favoritism. The matter you described is one where a person is likely to be overcome by his nature and self-love, and he will prefer his personal interest, prioritizing his private benefit, working more for it and exerting his effort in it,
while neglecting the work for the public interest, though he thinks he has not done so. And success is from Allah. May Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
