Q1: What is the ruling of the Shari'ah regarding one who is given money while at work without asking for it or using deception to obtain that money ? For example, the headman or the Shaykh of the neighborhood (district) comes to people to give them certificates because they are residents of his neighborhood, and they put money in his drawer or hand it to him directly.
Some give him fifty riyals, some give more, and some give less. Is it permissible to take this? Is this money considered lawful? And can the permissibility of this be inferred from the hadith of Salim ibn 'Abd Allah ibn 'Umar , from his father 'Abd Allah ibn 'Umar , from 'Umar (may Allah be pleased with them), who said: , agreed upon by al-Bukhari and Muslim . I quoted this hadith from the book (Dalil al-Falahin), and from the questions as well: An employee is given money without asking for it or using deception, is it lawful for him to take it?
A1: If the situation is as described, then what is given to this headman is forbidden; because it is a bribe. And there is no connection between the hadith of Ibn 'Umar (may Allah be pleased with them both) and this subject;
because it concerns one who is given something from the treasury of the Muslims by the ruler of the Muslims without asking or seeking it out. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
