Discussion of the Second Chapter on Prioritizing Analogical Reasoning over the Hadith

Machine translationRead the Arabic original
The Shaykh : The Second Chapter: Prioritizing Analogical Reasoning and Other Matters over the Hadith
O scholars, if an authentic hadith is rejected by analogical reasoning or by any of the other principles previously mentioned... and... by the practice of the people of Madinah which contradicts it, that is a clear contradiction of those aforementioned verses and hadiths which mandate returning to the Book and the Sunnah in cases of disagreement and dispute. Then, there is no doubt among the people of knowledge that rejecting a hadith in such cases as we have mentioned, by these principles, is not, and praise be to Allah, something upon which all the scholars agreed. Rather, the majority of scholars who oppose those principles and prioritize the authentic hadith over them, following the Book and the Sunnah—how could it be otherwise, since it is obligatory?—are the people of acting upon the hadith, even if there is... agreement on the contrary or lack of knowledge of who relied upon it.
