If anyone over-sleeps and misses the witr , or forgets it, he should pray when he remembers and when he awakes. من نام عن الوتر أو نسيه فليوتر إذا ذكره أو استيقظ

That he went out for the Fajr prayer and found the Prophet (peace and blessings be upon him) in the Fajr prayer, and he had not performed the two rak'ahs of the Fajr sunnah, so the Prophet (peace and blessings be upon him) passed by him and said, "What is this prayer?" He informed him, so the Prophet (peace and blessings be upon him) remained silent and said nothing. أنه خرج إلى الصبح فوجد النبي صلى الله عليه وسلم في الصبح ولم يكن ركع ركعتي الفجر فمر به النبي صلى الله علليه وسلم فقال ما هذه الصلاة فأخبره فسكت النبي صلى الله عليه وسلم ولم يقل شيئا
In *Al-Fath al-Rabbani*, after explaining the chapter from Ahmad and al-Tabarani in *Al-Awsat* from 'A'ishah, it is stated:

And from Abu al-Darda', reported by al-Hakim and al-Bayhaqi, with the wording:
I would sometimes see the Messenger of Allah (peace and blessings be upon him) praying the witr after the people had already stood up for the Fajr prayer. ربما رأيت رسول الله صلى الله عليه وسلم يوتر وقد قام الناس لصلاة الصبح
Al-Hakim graded it as authentic. What is your opinion, O Shaykh?

The Shaykh : I see that both matters are permissible, meaning that whoever forgets the witr or sleeps through it is treated exactly like the obligatory prayer in that he is ordered to perform it when he wakes up from his sleep or when he remembers what he had forgotten of the witr.

The questioner : Even if the dawn has already appeared?
The Shaykh: Yes, unless it causes him to miss a prayer, for example, the congregation. That is a different matter.
