What is the ruling on buying a debt from someone who has taken out a loan from the real estate bank? And what is the ruling on one who has not paid it off to this day, even though it is due and he is able to pay it?

The questioner : Peace be upon you.

The Shaykh : And upon you be peace.

The questioner : Your Eminence! What is the ruling on buying a debt from someone who has taken out a loan from the real estate bank? And what is the ruling on one who has not paid it off to this day, even though it is due and he is able to pay it?

The Shaykh : Yes. As for the first, we do not see it as permissible except if he goes to the responsible authority and the first party transfers his rights to the second. As for delaying repayment, it is forbidden if one is able to pay, due to the saying of the Prophet (peace and blessings be upon him):
Delaying the payment of a wealthy person is injustice. مطل الغني ظلم
. "Al-mutall" means delaying repayment. It is astonishing that some people—may Allah guide us among those He has guided—some people say: "The government's money has no sanctity." And they delay in paying the government's right. This is a mistake. The government's money has sanctity, because the money in the public treasury belongs to the Muslims in general. Every person has a right in it. But no one may take it exclusively without the others. Therefore, my advice to this brother who has delayed and procrastinated is to fear Allah (Mighty and Majestic), and to pay the installments that have come due, given his ability to do so. And who knows, perhaps he will die tomorrow or the day after, and remain hanging by his debt, and debt is not easy. The Prophet (peace and blessings be upon him), before Allah opened things up for him, used not to pray over anyone who had a debt, until a man from the Ansar was brought to him, and when he took a few steps, he said:
Did he have a debt? They said: Yes. They said: Did he have a debt? He said: Yes. So he stepped back and said: Pray over your companion. هل عليه دين؟ قالوا: نعم، قالوا : هل عليه دين؟ قال: نعم. فتأخر وقال : صلوا على صاحبكم
Look, my brother! The Prophet (peace and blessings be upon him), the most merciful of creation, said:
I will not pray over him; pray over your companion. Then Abu Qatadah (may Allah be pleased with him) said: The two dinars are on me, the two dinars are on me. He said: Is the creditor's right fulfilled and the deceased absolved? He said: Yes. So he stepped forward and prayed. لا أصلي عليه صلوا على صاحبكم. فقال أبو قتادة رضي الله عنه : الديناران عليَّ، الديناران عليَّ. قال : حق الغريم وبرئ منه الميت؟ قال: نعم. فتقدم وصلى
. And a man asked him about being killed in the cause of Allah:
Does it erase it? He said: Yes, it erases everything, and when he turned away, he said: Come, Jibril came to me and said: Except for debt.هل يكفِّر؟ قال: نعم يكفِّر كل شيء، ولما انصرف قال: تعال، أتاني جبريل وقال : إلا الدين
. Martyrdom in the cause of Allah does not erase debt, and the negligence of some people today regarding debt is a great mistake. You find one of them borrowing in order to buy a luxurious car; he finds a car for thirty thousand and says: "No, I will buy one for seventy thousand," or he finds a bed that is enough for his house for fifty thousand. He says: "No, I will buy one for one hundred thousand." And this is undoubtedly foolishness and a mistake. The common people say a very good example, which is: what is it? "Stretch your leg according to the length of your blanket" meaning: if a person's blanket is short and his legs are long, he does not stretch his legs—"he wraps himself up"—so that the cover is over the entire body.
Now "The departure is near, except that our riders *** have not yet settled their saddles, as if it were so".
The allotted time has ended. And until a future meeting, if Allah wills. And whoever has a question that has not been answered, the telephone is [3642107].

The questioner : May Allah reward our father and our Shaykh with the best reward. And may Allah reward you with good for your attendance, and may Allah send prayers and blessings upon His servant and Messenger Muhammad. And I remind my brothers that there will be, if Allah wills, and this will be announced, a lecture by Shaykh Salih al-Fawzan, a member of the Committee of Senior Scholars, at the al-Sulaymaniyah Mosque on the coming Friday after the Maghrib prayer, if Allah wills.
