The questioner : In past years, we used to let our head hair grow before Hajj so that we would shorten it after completing 'Umrah, and then shave it when exiting the state of ihram from Hajj. However, we comb our head hair during ihram because it is not very long, and hair falls out, or a little hair falls out if the falling is not nonexistent. We comb it with a comb because if the hair is not combed, it looks ugly in the eyes of people. Do we have any obligation regarding combing it, and what is the ruling on hair that falls out unintentionally? Please inform us, and may Allah guide you.

The Shaykh : It is not recommended for a person in ihram to comb his head, because what is recommended for a person in ihram is to be unkempt and dusty. There is no blame on him if he washes it, but as for combing it, it is prone to causing hair to fall out. However, if hair falls from a person unintentionally, whether due to scratching his head, rubbing it, or something similar, there is no blame on him in this, because he did not intend to remove it. It should be known that all the prohibitions of ihram, if a person does not intend them and they occur from him by mistake or by forgetfulness, there is no blame on him regarding them. This is because Allah, Glorified and Exalted is He, said in His Book:
And there is no blame upon you for that in which you have erred but [only for] what your hearts intended وليس عليكم جناح فيما أخطأتم به ولكن ما تعمدت قلوبكم
[Al-Ahzab 33:5]
And He, Glorified and Exalted is He, said:
Our Lord, do not impose blame upon us if we have forgotten or erred. ربنا لا تؤاخذنا إن نسينا أو أخطأنا
[Al-Baqarah 2:286]
And Allah, Glorified and Exalted is He, has done this, and specifically regarding hunting, which is one of the prohibitions of ihram, Allah the Exalted said:
And whoever of you kills it intentionally - the penalty is an equivalent from sacrificial animals to what he killed ومن قتله منكم متعمدا فجزاء مثل ما قتل من النعم
[Al-Ma'idah 5:95]
This condition of "intentionally" indicates that one who kills it unintentionally has no expiation to pay. This condition is a precautionary condition because it is a condition appropriate to the ruling. That is because intention is what is appropriate for the obligation of expiation, whereas non-intention is not appropriate for the obligation of expiation. This is based on what is known from this Islamic religion that it is a religion of leniency, ease, and simplicity. Therefore, we say that all the prohibitions of ihram, without exception, if a person does them while ignorant or forgetful, none of their rulings apply to him, neither the obligation of fidyah (ransom payment) nor the invalidation of the ritual in cases that invalidate the ritual, such as sexual intercourse. This is what the evidence we referred to necessitates. And Allah is the One who grants success.
