The questioner : The questioner says: What is the ruling in Islam regarding a Muslim woman serving intoxicants to her husband; if she does not do so, he threatens to divorce her; knowing that his wife prays?

The Shaykh : The answer to this is well known:
A creature is not to be obeyed when it involves disobedience to the "Creator.” لا طاعة لمخلوق في معصية الخالق
Mishkat al-Masabih 3696
, and it is not permissible for a woman to obey her husband in disobedience to Allah (Mighty and Majestic), and his divorcing her is better for her. Our Lord (Mighty and Majestic) says:
And if they decide on divorce - then indeed, Allah is Hearing and Knowing. وَإِنْ عَزَمُوا الطَّلَاقَ فَإِنَّ اللَّهَ سَمِيعٌ عَلِيمٌ
[Al-Baqarah 2:227]
; especially if the one driving to this divorce is the righteous woman, because her obedience to Allah and her disobedience to her husband out of fear of the command of Allah (Mighty and Majestic). Nevertheless, there may be specific or particular cases where, if the details of the case are clarified, it can be said that if this woman is divorced from her husband, her household and that of her children will be scattered; so it may be from the category of the lesser of two harms that she remains with her husband. But we do not issue a fatwa to this effect because it is contrary to the original ruling, and the matter is as He (Glorified and Exalted is He) said:
Rather, man, against himself, will be a witness, بَلِ الْإِنْسَانُ عَلَى نَفْسِهِ بَصِيرَةٌ
[Al-Qiyamah 75:14]
