The questioner: Our Shaykh.

The Shaykh: Excuse me, I want to say to the brother, “Salman al-Oudah,” my brother.

The questioner: “Salman al-Oudah,” yes.

The Shaykh : In his lecture.

The questioner: In Algeria?

The Shaykh: In his lecture on the jurisprudence of reality, he says: that a scholar who has no knowledge of reality, his legal ruling will not be correct; so he is like he is depicting this because of the heat that followed him.

The questioner : He is young.

The Shaykh: This is it, because of the heat that followed him, he comes out saying non-Shari'ah words!! From this Shari'ah speech, and this is the cause of stirring up others, this is within the limits of the tapes, and perhaps when we gather with some of them, something more will become clear to me. I had three coming a few days ago, I don’t know, did you know?

The questioner: A few days ago, or in Sha'ban?

The Shaykh: No, no.

Another questioner : Four days ago.

The Shaykh : Four days ago.

The questioner: Good.

The Shaykh: Yes, and with them come more than twenty questions.

The questioner : On this topic?

The Shaykh: Regarding the apparent disagreement that arises, yes, so I drew their attention to the fact that the heat in the jurisprudence of reality means there is no need to stir it up, especially among the masses of people.
Now, for example, this jurisprudence of reality is stirred up among students, it is not stirred up in a lecture.

The questioner: Yes, yes; because the common people need to hear what Allah said and what the Messenger said.

The Shaykh: It would have been, ah, even so, if it were in the limited sense that you mentioned just now, meaning a specialization that is acceptable and reasonable, but he did not say that; rather, on the contrary, he said that if a scholar does not have knowledge of reality, his fatwa will not be a correct fatwa. From here came the exaggeration, and this exaggeration creates a reaction with the other party. I asked you just now about our brother “al-Rabi,” what is his position? I told them these three, just as I said when I had “al-Walid” here.

The questioner: Yes.

The Shaykh: I gave a lecture, and the lecture may be published; that I do not think a student of knowledge, let alone a scholar, would deny the importance of the jurisprudence of reality, but he did not make it an individual obligation; meaning every scholar must be a scholar in what? In the jurisprudence of reality; so every scholar must be a scholar in politics, economics, society, medicine, and so on; this is impossible. And for a reason, He said - the Exalted - :
And their affair is by consultation among them وَأَمْرُهُمْ شُورَى بَيْنَهُمْ
; so this specialization and this social specialization is what gives the correct fatwa. So the exaggeration and this heat that accompanies the youth is the basis of the problems that are stirred up in the present age.
