The Shaykh : What comes to my mind is that this is separated from the first question; so I say:
It is permissible for a Muslim state to employ a non-Muslim if it cannot find a Muslim, and especially a competent Muslim. However, if a Muslim state cannot find a Muslim to work in one of its positions, there are rulings for that necessity at that time. It is established from 'Umar ibn al-Khattab (may Allah be pleased with him) that it was reported to him that Abu Musa al-Ash'ari (may Allah be pleased with him), who was a governor appointed by 'Umar in some of the lands, had employed a Christian scribe in his administration. 'Umar forbade him from doing so and was severe in his disapproval of it. In reality, this is part of Islamic policy that some Muslim rulers in the past did not pay attention to, so they began to make room for non-Muslims, the righteous ones among them, by bringing them into the state departments. They even brought in some who were not Muslims at all. This was one of the causes that the Muslim state declined and perished along with the states of those who perished.
Therefore, the original ruling is that it is not permissible to employ a disbeliever in state positions that relate to the administration of the state's affairs and its policy. This is different from employment in jobs that have no connection to the general Islamic policy of the Muslim state. In this case, it is not hidden that this is among the permissible matters, such as hiring workers for roads, mines, and the like, where it does not occur to one that they might exploit their positions for other than the Islamic interest.
