But regarding the dates, there is an explicit text that if it is rain-fed, he owes one-tenth, and if it is irrigated, he owes what? Half of one-tenth, yes. This criterion and these restrictions do not apply to the owner of the apricots. But the owner of the apricots looks at what is feasible for him, as we said, from the perspective of purifying the soul. But here is a very sensitive point: the zakah on fruits and livestock was collected by the state, even against the will of their owners, unlike the zakah on the two currencies (gold and silver). The matter of the zakah on the two currencies is left to the rich people themselves. The tax collector, in the language of the old Arabs, or the collector, in the language of the modern era, does not come to count how much money each rich person has in gold or silver, and then take two and a half percent. No, this matter is left to the conscience of this rich person. Unlike the charity on livestock, fruits, and crops, where at the time of harvest this collector comes and takes the zakah. Even if the rich person refuses, against his will, there is a ruling in an authentic hadith that if he refuses, it is taken from him doubled as a punishment for him. So if we assume the collector comes at the season of picking or gathering the dates, he takes his right according to the previous details: is it irrigated or not irrigated? Whereas he does not come to the owner of the apricots and say: “Give it,” because he does not have zakah on it. But this owner of the apricots gives out what his soul is pleased with to his poor, his neighbors, and so on.
The Shaykh: So His saying (Glorified and Exalted is He):
give its due [zakah] on the day of its harvest وَآتُوا حَقَّهُ يَوْمَ حَصَادِهِ
