The Shaykh : As for organ transplantation, many muftis today hold this view, but I do not consider it permissible in any case. Islam here, too, displays its superiority over other religions and over all earthly schools of thought. They observe matters that others do not notice, or they notice them but do not give them weight. Islam, for example, says:
Breaking the bone of a deceased believer is like breaking it while he is alive كسر عظم الميِّت المؤمن ككسره حيًّا
. If a Muslim doctor says that if there is a person with a sound constitution and another who has lost one of his limbs, he permits the doctor to cut an organ from the healthy person and attach it to the person who lost the organ, this may be adopted... for the human being whom Allah (Mighty and Majestic) distinguished, as He said:
And We have certainly honored the children of Adam and carried them on the land and sea وَلَقَدْ كَرَّمْنَا بَنِي آدَمَ وَحَمَلْنَاهُمْ فِي الْبَرِّ وَالْبَحْرِ
[Al-Isra 17:70]
to the end of the verse. Allah honored the human being within the limits of this honor by forbidding him certain things, while others consider them permissible. He forbade changing the creation of Allah in the broadest sense, except for what Allah has permitted, and He forbade mutilation, even in the case of disbelievers who are killed. It is not permissible for a Muslim to mutilate a disbeliever if he falls dead in a battle. So if one of the Muslim doctors permits this transaction of transferring an organ from a living person to another person, because he has allowed it, and I do not think... he says that; in that case, it becomes easy for us to understand the previous hadith:
Breaking the bone of a deceased believer is like breaking it while he is alive كسر عظم الميِّت المؤمن ككسره حيًّا
. Therefore, I do not see the permissibility of organ transplantation which has become prevalent in this time.
