The questioner : In the name of Allah, the Most Gracious, the Most Merciful.
Your Eminence, what is your opinion of people who go to Hajj every year but stay outside the boundaries of Mina seeking comfort, so that their car is right next to them, even though if they entered Mina they would find places, but they are rough in the mountains or such? What should we say to them?

The Shaykh : Tell these people who stay outside Mina when it is possible to stay in Mina that they are sinful and transgressing the limits of Allah, because it is obligatory for the pilgrim to be in Mina unless he cannot find a place. Indeed, Allah the Exalted says in His Book:
Allah does not charge a soul except [with that within] its capacity لا يُكَلِّفُ اللَّهُ نَفْساً إِلَّا وُسْعَهَا
[Al-Baqarah 2:286]
and He says:
So fear Allah as much as you are able فَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[At-Taghabun 64:16]
And the Prophet (peace and blessings be upon him) granted a dispensation to his uncle al-Abbas to leave the overnight stay in Mina during the nights of Mina for the sake of providing water to the pilgrims. So one who is unable to do so is even more excusable. But as for those who are able, yet they say: "We want comfort," I advise them to have more comfort than this by staying in their homes, so that they do not burden themselves with the hardship of travel, expenses, and parting from their families. Hajj necessarily involves hardship because it is jihad, as the Prophet (peace and blessings be upon him) said when Aisha asked him:
"Is there jihad for women?" He said: "Yes, a jihad in which there is no fighting: Hajj and 'Umrah." هل على النساء جهاد ؟ قال : نعم جهاد لا قتال فيه الحج والعمرة
Sunan al-Bayhaqi 4:143
And the Exalted said:
And spend in the way of Allah and do not throw [yourselves] with your [own] hands into destruction [by refraining]. And do good; indeed, Allah loves the doers of good. وَأَنْفِقُوا فِي سَبِيلِ اللَّهِ وَلا تُلْقُوا بِأَيْدِيكُمْ إِلَى التَّهْلُكَةِ وَأَحْسِنُوا إِنَّ اللَّهَ يُحِبُّ الْمُحْسِنِينَ
[Al-Baqarah 2:195]
And complete the Hajj and 'umrah for Allah وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ
[Al-Baqarah 2:196]
