What is the stronger opinion regarding the issue of executing a free person for the murder of a slave? If a free person kills a slave, is he executed for it?
The stronger opinion is that he is executed for it;because of His saying, the Exalted:
And We ordained for them therein a life for a life, an eye for an eyeوَكَتَبْنَا عَلَيْهِمْ فِيهَا أَنَّ النَّفْسَ بِالنَّفْسِ وَالْعَيْنَ بِالْعَيْنِ
[Al-Ma'idah: 45] ,And the saying of the Prophet (peace and blessings be upon him): (The blood of a Muslim is not lawful except in one of three cases: a life for a life) and the saying of the Prophet (peace and blessings be upon him): (The blood of the believers is equal, and the weakest among them is sufficient to seek justice for the strongest) and the saying of the Prophet (peace and blessings be upon him): (No Arab has superiority over a non-Arab except by piety) and the saying of Allah the Exalted:
Indeed, the most noble of you in the sight of Allah is the most righteous of youإِنَّ أَكْرَمَكُمْ عِنْدَ اللَّهِ أَتْقَاكُمْ
[Al-Hujurat: 13] These general texts indicate that a free person is executed for a slave, just as a slave is executed for a free person, and there are no authentic texts indicating that a free person is not executed for a slave.
