Ruling on the questioner saying: “What is the ruling of the Shari'ah in this issue?” and offering the greeting when asking

Machine translationRead the Arabic original
Peace be upon you, and Allah's mercy and blessings. Some questioners, when they want to ask one of the shaykhs a question,He said: say, “What is the ruling of the Shari'ah in this issue?” or “What does the Shari'ah say about this issue?” Please give us a ruling, may Allah reward you with good.

The statement attributing the word: Asking “What does the Shari'ah say?” or “What is the ruling of the Shari'ah?” to a person who makes mistakes and hits the mark is an error; because the Shari'ah is not tied to a person except the Prophet (peace and blessings be upon him), who is the one who is not left in error in the religion of Allah. As for anyone other than the Messenger (peace and blessings be upon him), you cannot say: “What is the ruling of the Shari'ah?” when he is a human being who makes mistakes and hits the mark. But say: “What is the ruling of the Shari'ah in your view?” or “What is your opinion about such-and-such?” This is the safer and more appropriate way.Suppose you said to this man: What is the ruling of the Shari'ah?So he said: Saying “The ruling of the Shari'ah in such-and-such is that it is forbidden” when it is not forbidden, becomes a lie about the Shari'ah.For this reason we see: The best way to express it is to say: “What is the ruling of the Shari'ah in your view?” or “What do you see regarding such-and-such?” As for starting the question with the greeting while sitting with the one being asked, this is not from the Sunnah.Meaning: You find some people now in the gathering, and then they say: “Peace be upon you and Allah's mercy, what is the ruling on such-and-such?” This is not from the Sunnah; because those who used to ask the Messenger (peace and blessings be upon him) in their place did not offer the greeting. Rather, the one who offers the greeting is the one who comes forward, as in the hadith of the one who messed up his prayer, who came and prayed in a corner of the mosque a prayer in which he did not settle, then he came and greeted the Messenger (peace and blessings be upon him), who returned the greeting and said: (Go back and pray, for you have not prayed) So this is fine, he offers the greeting, but a person sitting in the circle who, when he wants to raise a question, says: “Peace be upon you and Allah's mercy,” this is not from the Sunnah. And it is known that we are followers in the sense that: We should walk in our acts of worship according to what has been prescribed for us, neither going beyond nor falling short. But I say: And upon you be peace, and Allah's mercy and blessings.
