What is the criterion for the person on whose behalf Hajj is performed, especially since we find many benefactors who allocate part of their wealth for certain people to perform Hajj with, and some of them happen to be in debt? Is it permissible for the recipient of the money to pay off the debt from this money, or is it obligatory for him to perform the entire Hajj with it?
As for the person on whose behalf Hajj is performed, the Sunnah only came regarding the obligatory Hajj for one who is unable to perform it himself, and it never came regarding voluntary Hajj. The utmost of what is there is what came in the hadith of 'Abdullah ibn 'Abbas (may Allah be pleased with them both): (That the Prophet (peace and blessings be upon him) heard a man saying: Labbaik on behalf of Shubrumah.
So he said: Who is Shubrumah?He said: A brother of mine or a relative of mine.

He said: Have you performed Hajj for yourself?He said: No.

He said: Perform Hajj for yourself, then perform Hajj for Shubrumah).

Some people may cling to this hadith and say: The Messenger (peace and blessings be upon him) did not ask him: Is your Hajj on behalf of Shubrumah obligatory or voluntary?It is said: The Hajj is capable of being interpreted,But his saying: (Perform Hajj for yourself, then for Shubrumah) indicates that this Hajj is obligatory. So, delegation for the obligatory Hajj in the case of inability came by the Sunnah, and delegation for voluntary Hajj did not come by the Sunnah at all, but some scholars analogized it to the obligatory one.

Then some scholars expanded on this and said: It is permissible for one who is able to delegate someone to perform voluntary Hajj on his behalf, but as for the obligatory one, it is not permissible. As for me, I do not like people to expand on this,We say: whoever has surplus wealth and wants to give it to someone to perform Hajj on his behalf, let him give it to someone who performs the obligatory Hajj, and you will have helped a person in performing an obligation, and you will be written a reward like his;Because the Prophet (peace and blessings be upon him) said: (Whoever equips a warrior has gone on a jihad) .
Likewise, whoever equips a pilgrim, it is hoped that he will be like the one who equipped a warrior,Meaning: and the reward of Hajj will be written for him,This is better than that we say: Take these dirhams and perform Hajj on my behalf, and you are able to perform Hajj yourself,Have you seen if I said to a person: I am tired today, so I have performed the obligation in the Zuhr prayer and I am unable to perform the voluntary one, so take these dirhams and pray the rawatib on my behalf? There is no doubt that this is not sufficient. Therefore, it should not be that we expand on this issue,And we only say to the one who has surplus wealth: It is better that you assist someone who performs Hajj or 'Umrah, and then you will have a reward, if Allah wills.
And as for the one who took money for Hajj and has a debt, and he paid off some of his debt with it, there is no harm if he performed the Hajj in the manner that is required.
