The Response to Those Who Said That Tamattu' Is Obligatory in Hajj

Machine translationRead the Arabic original
Your Eminence the Shaykh, may Allah preserve you: How is the response to be made to those who said that tamattu' is obligatory?

The response is from two angles: The first approach: It is established in Sahih Muslim from Abu Dharr (may Allah be pleased with him) that he was asked about breaking up a Hajj performed as ifrad or qiran into an 'Umrah in order to become a mutamatti',It was said to him: Is this specific to you or general for the people? So he said: Rather, it is specific to us.

The second aspect: The one who says it is obligatory is not more knowledgeable than Abu Bakr and 'Umar (may Allah be pleased with them both), nor more juristic in the religion of Allah than they were.

If someone were to say: As for the first, it is opposed by the statement of Abu Dharr that when Suraqah ibn Malik ibn Ju'asham said to the Prophet (peace and blessings be upon him): "Have you made it lawful and made it an 'Umrah? Is this for our time or forever?"He said: "Rather, it is forever" And this indicates that it is not specific to the Companions,We said: We derive from this that the intended meaning of Abu Dharr (may Allah be pleased with him) is: the obligation is specific to the Companions, whereas for the rest of the people it is recommended.
And with this we reconcile the statement of the Messenger (peace and blessings be upon him) and his command for tamattu' with the statement of the Rightly Guided Caliphs that the obligation is upon the Companions; because they are the ones addressed by the command, and their disobedience to the Messenger would lead to those after them disobeying him all the more; because they are the role model. Then, the difficulty that existed among the people at that time, which was that one does not combine 'Umrah and Hajj in one journey, was removed by the Companions (may Allah be pleased with them) exiting the state of ihram, so the cause of the obligation was removed. This is the answer.
And the correct view is that tamattu' is better and is not obligatory.
