The ruling on the farewell tawaf before the completion of the stoning, and the ruling on delegating the stoning
Machine translationRead the Arabic original
A group of people, men and women, are performing Hajj. When the twelfth day arrives, they take their women down to the Ka'bah in the morning to perform the farewell tawaf, then return them to their tents in Mina. They then perform the stoning on their behalf and for themselves. After that, the men go down to the Ka'bah a second time to perform the farewell tawaf, and then they return to their families. Is this action valid with regard to their women? Knowing that they do this only during the crowd, and whether they have to offer a sacrificial animal or not? Knowing that the women are not sick.
The farewell tawaf is not permissible except after the complete completion of the rites;Because the Prophet (peace and blessings be upon him) said: (No one should depart until his last visit is to the House) If one performs the farewell tawaf and then returns to perform the stoning, he has made his last visit to the stoning. So whoever performs the tawaf before the completion of the rites, his tawaf is out of place. And if he does not repeat it after the completion of the rites, he has to offer a sacrificial animal, which they slaughter in Makkah and distribute to the poor. So now, each one of these people—men and women—has to offer a sacrificial animal for the farewell tawaf; because it was performed out of place.
As for the stoning, if they are in a hurry and the crowd is severe, I think the women should delegate, even if they are active; because the crowd is severe, and the woman—whatever the case— is weak. But if it is normal and not severe, they should not delegate. The matter should be looked into. If they delegate while at the same time being capable of performing the stoning themselves; then this delegation is not valid, and each one of them has to offer a sacrificial animal. But if there is a situation of severe crowding; then there is no harm in their delegating.
And here I point out this issue, which is the issue of stoning. Many pilgrims are lax about it and delegate while being capable, and this is not valid for them; because stoning the pillars is part of the rites,And Allah the Exalted said: [al-Baqarah: 196] Just as you do not tell a person: go and perform the farewell tawaf for me, or go and perform the tawaf of ifadhah for me, or go and spend the night for me in Muzdalifah, or go and stand for me at 'Arafah, so likewise it is not permissible to delegate a person and tell him: stone for me, except if one is completely unable, such as a sick person, an elderly person, a pregnant woman, a child who cannot handle the crowd, and the like.
