The questioner : A questioner asks: A group of people, men and women, are performing Hajj. When the twelfth day arrives, they take their women down to the Ka'bah in the morning to perform the farewell tawaf, then return them to their tents in Mina. They appoint proxies to throw the pebbles on their behalf and on behalf of the women. Then the men go down to the Ka'bah a second time to perform the farewell tawaf, and then they return to their families. Is this action valid with regard to their women? Knowing that they do this only out of fear of the crowd. And is a sacrificial animal required of them or not? Knowing that the women are not ill.

The Shaykh : The farewell tawaf is not permissible except after the rites are completely finished, because the Prophet (peace and blessings be upon him) said:
No one should depart until his last visit is to the House لا ينفر أحد حتى يكون آخر عهده بالبيت

And if one performs the tawaf for farewell and then returns to throw the pebbles, he has made his last act the throwing of the pebbles. So if one performs the tawaf before the rites are finished, his tawaf is not in its proper place. And if he does not repeat it after the rites are finished, a sacrificial animal is required of him, which he slaughters in Makkah and distributes among the poor. So now, every one of these people, men and women, has a sacrificial animal required of him for the farewell tawaf, because it was performed in a place other than its proper place.
As for the throwing of the pebbles, if they are hastening and the crowd is severe, as in this year, the year 1414, I see that the women should appoint proxies even if they are active, because the crowd is severe, and a woman, however weak she may be. But if it is ordinary, they should not appoint proxies. The matter should be looked into: if they appoint proxies while at the same time being capable of throwing the pebbles themselves, this appointment is not valid, and a sacrificial animal is required of each one of them. But if it is in a state of severe crowding, there is no harm in their appointing proxies.
And here I point out this issue, which is the issue of throwing the pebbles. Many pilgrims are negligent in it and appoint proxies while they are capable, and this is not valid from them. Because throwing the pebbles is part of the rites. And Allah the Exalted said:
And complete the Hajj and 'umrah for Allah وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّه
[Al-Baqarah 2:196]
Just as you do not say to a person: "Go and perform the farewell tawaf for me," or "Go and perform the tawaf of ifadhah for me," or "Go and spend the night for me in Muzdalifah," or "Go and stand for me at 'Arafah," so likewise it is not permissible to appoint a person and say: "Go and throw the pebbles for me," except if one is completely unable, such as a sick person, an elderly person, a pregnant woman, a child who cannot handle the crowd, and the like of that.
