The questioner : What is the ruling on the witr prayer if one has not prayed it and the time for the iqamah of the Fajr prayer has arrived? Does he pray it, or does he pray Fajr with the congregation?

The Shaykh : No, he does not pray it once the prayer has been called for; because the Messenger (peace be upon him) said:
When the Iqamah has been called for the Salat then there is no Salat except the obligatory. إذا أُقِيمَتِ الصلاةُ فلا صلاةَ إلا المكتوبة

, and witr is a recommended practice (sunnah) and not obligatory. He is only permitted to pray it after the sun rises. It is better for him to pray twelve rak'ahs, because that is what came in the Sunnah... However, there is no harm in him making up this witr that he missed, having preferred the Fajr prayer with the congregation over it. He has the choice between praying witr as he used to pray it before, and it is better for him to pray twelve rak'ahs in the late morning.
