A man was involved in a traffic accident in which three people died: a woman, a daughter, and a man, and this man was the cause of the accident according to the report of the competent authorities,He says: and his financial situation is poor, so he was involved in another accident and is now in the hospital and unable to fast, and he has heard that in some Islamic countries slavery still exists, and he says: Should he borrow a sum of money to free a slave, and if the money is available, where are the ones who are to be freed, and what is the way to do that? What should he do? May Allah reward you.

First: We must know about the accident and have it described to us, because sometimes some people think that for every accident that occurs, the liability falls on the one who caused it, but that is not the case, and we are now issuing a ruling based on the assumption that the accident entails liability, so we say: First: he owes three blood money payments to the guardians of the murdered, which are to be paid by his family, and if they pardon him, there is no blame, and the blood money is dropped.

Second: He owes three expiations,And the expiation: freeing a slave, and if he does not find one, then fasting two consecutive months, and on this basis, he owes three slaves to be freed if he is able and has money in excess of his needs, and if he does not have money; then he must fast two consecutive months for each person, and if he is unable to do so, he owes nothing; because Allah the Exalted mentioned the expiation for killing and did not mention anything except two things only, which are: freeing a slave, then fasting, and He did not mention food.

And his statement: He borrows or asks for a loan, we say: do not borrow and do not ask for a loan, if the money is not available to you, the freeing of a slave is dropped from you except for fasting, and if you are unable to fast, the expiation is dropped from you by the saying of Allah the Exalted:
Allah does not charge a soul except [with that within] its capacityلا يُكَلِّفُ اللَّهُ نَفْساً إِلَّا وُسْعَهَا
[al-Baqarah: 286] .
