If the one paying the zakah takes it from the wealth of one of the partners, he has a claim against the other for the portion of this zakah that is due from him.For example: If one has forty animals and the other has twenty, he has a claim against him for one-third if the owner of the forty is the one who paid it, and he has a claim against him for two-thirds if it was taken from the wealth of the owner of the twenty; because mixed wealth is like a single wealth.

Does he have to pay zakah, or does he not pay any zakah?Answer: If the second partner approves of the transaction of his partner, there is nothing wrong with it, especially if the obligatory amount in the zakah is a single item,For example: a single sheep that cannot be divided. However, if the obligatory amount is two sheep and their wealth is equal, we might say in this case: wait in order to pay your own zakah, and let your partner pay his own zakah. And with this, we say: if the owner approves of it, there is nothing wrong with it.
