A man wanted to divide his wealth among his children. Should he give the male a share equal to that of two females, based on Allah’s saying in the verse:
Allah commands you regarding your children.يُوصِيكُمُ اللَّهُ فِي أَوْلادِكُمْ.
[Al-Nisa: 11], or should he divide it equally among them, based on the Prophet’s (peace and blessings be upon him) saying: “Be just among your children”? And if he does the former during his lifetime and then dies, should what the males took be recovered and given to the females?
First, we ask: is what he gave maintenance or an additional gift? If it is maintenance, he gives each person what they need, whether little or much. So if one of the children needs to get married, he marries him, and he does not give the others the same. And if, for example, one of the daughters falls ill and he spends a large amount on her medicine, he does not give the others the same.
As for a gift, he gives the male a share equal to that of two females; because there is no division more just than the division of Allah (Mighty and Majestic). So if he gives the male one hundred, he gives the female fifty, and he does not recover what he gave the males after his death; because this is a right and justice that the male has a share equal to that of two females.and the hadith, he said: “Be just among your children”, and justice among them is following what the Sunnah brought and what the Shari'ah indicated. This is justice.
And we should know the difference between justice and equality.Now many people say: Islam is a religion of equality, and this is a mistake. The word "equality" or the statement that people are equal does not appear in the Qur'an. Rather, if you reflect more on what is in the Qur'an, you will find the negation of equality:
Not equal among you are those who spent before the conquest [of Makkah] and foughtلا يَسْتَوِي مِنْكُمْ مَنْ أَنْفَقَ مِنْ قَبْلِ الْفَتْحِ وَقَاتَلَ
[al-Hadid: 10] ,
Not equal are those believers remaining [at home]لا يَسْتَوِي الْقَاعِدُونَ مِنَ الْمُؤْمِنِينَ
[al-Nisa: 95] ,
Say, "Is the blind equivalent to the seeing? Or is darkness equivalent to light?قُلْ هَلْ يَسْتَوِي الْأَعْمَى وَالْبَصِيرُ أَمْ هَلْ تَسْتَوِي الظُّلُمَاتُ وَالنُّورُ
[al-Ra'd: 16] and the like. Most of what is in the Qur'an is the negation of equality between those who differ.

In the Qur'an there is justice:
Indeed, Allah orders justice and good conductإِنَّ اللَّهَ يَأْمُرُ بِالْعَدْلِ وَالْإحْسَانِ
[An-Nahl: 90]
Be just; that is nearer to righteousnessاعْدِلُوا هُوَ أَقْرَبُ لِلتَّقْوَى
[Al-Ma'idah: 8], and there is a difference between justice and equality.If we took the apparent meaning of the word “equality,” we would say: The male and the female are equal, as the onlookers now proclaim. But if we say justice, we give the male what he deserves and the female what she deserves. For this reason, we hope that our brothers, the People of the Book and others, will pay attention to this point; because the word “equality” was introduced by some of the contemporaries, and Allah knows how they introduced it. It may be due to a misunderstanding, or it may be for another reason. The religion is a religion of justice, and justice is giving each person what he deserves.
