Ruling on the shop owner fixing a specific monthly amount from the worker
There is a person who has an establishment; he always opens shops and brings the supplies for the shop, saying:And he brings in people to work for him and says: "You must work in this department—for example—and I will take four thousand or five thousand from you every month," and he forces them to do so. Is this permissible?
This is, may Allah bless you, forbidden. It is forbidden for a person to open a shop and bring in a worker to work in it and say: You get every month—for example—one thousand riyals, or two thousand, or less, or more. This is forbidden by the Shari'ah and prohibited by the system, and the state does not allow this if the worker is a foreigner. If he is a national, it is still forbidden from the standpoint of the Shari'ah, so it is not permissible. Yes, if it were assumed that he prepared the capital and then brought in a man and said to him: O so-and-so! Work with this capital on a fifty-fifty basis; half the profit is for you and half the profit is for me, or three-quarters of the profit is for you and a quarter is for me. There is nothing wrong with that, because this is a profit-sharing partnership.
