A group of people set out from Riyadh to Jeddah and stayed there for three days. Their intention was to go to Jeddah and remain there for three days, and then proceed to Makkah. When the three days had passed and they were in Jeddah, they entered the state of ihram from the house, then went to Makkah and performed the 'Umrah. What is the ruling?
These people have made a mistake. It is obligatory for them to enter the state of ihram from the miqat, perform the 'Umrah, and then go to Jeddah. Or, when they finish in Jeddah, they should return to the first miqat they passed and enter the state of ihram from there. Since they came from Riyadh, it is obligatory for them, when they intended to enter the rites of pilgrimage, to go to al-Sayl, which is Qarn al-Manazil, and enter the state of ihram from there.And the matter is as I said: If they entered the state of ihram from Jeddah, the scholars say that one who enters the state of ihram from other than the miqat is required to sacrifice an animal. That is, he slaughters a fidyah in Makkah and distributes it to the poor. This is if he is wealthy. If he is poor, he should repent to Allah, for Allah does not burden a soul beyond its capacity.
As for the minor who has not reached puberty, he owes nothing.
