Passing the Miqat in 'Umrah

Machine translationRead the Arabic original
Question:
The Shaykh (may Allah guide you) said: A woman says: A woman went out for 'Umrah from Tabuk with the intention of performing 'Umrah by plane, and she slept and did not wake up until she was in Jeddah, having passed the miqat without entering into the rites. It is known that she had performed ghusl and avoided the prohibitions before boarding the plane. What is required of her?

Answer:
She was required to return to the miqat and enter into ihram. However, if she entered into ihram from Jeddah, she owes a fidyah because she passed the miqat. It is not sufficient that she was prepared by performing ghusl and wearing what she needs for ihram; this is not enough. It is obligatory to have the intention. Ihram is the intention to enter into the rites at the miqat. She did not do that. If she had foreseen this, she would have returned and entered into ihram from the miqat, thereby making up for it. But if she entered into ihram from Jeddah, she owes a fidyah because she left an obligatory duty of 'Umrah. Yes.
