The ruling on being forced to divorce and its consequences
Machine translationRead the Arabic original
Honorable Shaykh! A man divorced his wife twice, and the last time, his wife’s brothers forced him to divorce her because her brother discovered that her husband had been going to a fortune-teller.So he said: They said, “You must divorce your wife because you are a disbeliever?”
If being forced to divorce is done in a way that harms the husband, such as being threatened with death by someone capable of killing him, or with imprisonment, or with taking money that would harm him, then if he divorces, it is not a valid divorce, even if he divorces a hundred times; because he is coerced. The Prophet (peace and blessings be upon him) said: “There is no divorce under compulsion” , and the coerced person is one who is compelled; had it not been for the coercion, he would not have divorced. However, if it is merely that they insist on it or advise him to do it, that is not coercion, and if he divorces, the divorce takes effect.
