His Eminence the Shaykh: Some of the people of our country went for the 'Umrah, and the prescribed miqat is at Yalamlam on the plane, but they entered the state of ihram in Jeddah, and some of them entered the state of ihram at Tan'im.And he said: Because I am looking for a hotel and other such matters, is this permissible or not?
If a person enters the state of ihram for Hajj or 'Umrah from other than the miqat designated by the Messenger of Allah (peace and blessings be upon him), then the ihram is binding and valid, and the Hajj and 'Umrah are valid.But the scholars say: Performing the ihram from the miqat is among the obligatory acts of Hajj or 'Umrah, and whoever leaves an obligatory act of Hajj or 'Umrah, he must offer a fidyah (ransom payment) to make up for this deficiency, which is slaughtered in Makkah and distributed to the poor, and he does not eat any of it.Then if he is unable, some of them said: He fasts for ten days.And some said: He owes nothing.And the correct view is: That he owes nothing if he is unable to do so; because there is no sound evidence that one who is unable to offer the fidyah for leaving an obligatory act must fast for ten days.
